Common Legal Terms
Following are definitions for the most common legal terms:
Counseling
A consultant (from the Latin consultare means "to discuss"
from which we also derive words such as consul and counsel)
is a professional who provides advice in a particular area of
expertise such as law, management, accountancy, technology
or human resources, for example. Clients benefit from using a
consultant by having access to specialized expertise. It is
generally accepted good practice to hire consultants prior to
making decisions that could result in potential litigation.
Lawsuit and Litigation
A lawsuit may involve dispute resolution of private law issues
between individuals, business entities or non-profit
organizations. A lawsuit may also allow the government to be
treated as if it were a private party in a civil case, as plaintiff or
defendant regarding an injury, or may provide the government
with a basis to enforce certain laws. The conduct of a lawsuit
is called litigation.
A lawsuit is a civil action brought before a court of law in which
a plaintiff, a party who claims to have received damages from
a defendant's actions, seeks a legal or equitable remedy. The
defendant is required to respond to the plaintiff's complaint.
If the plaintiff is successful, judgment will be given in the
plaintiff's favor, and a range of court orders may be issued to
enforce a right, award damages, or impose an injunction to
prevent an act or compel an act. A declaratory judgment may
be issued to prevent future legal disputes.
Trial
A jury trial is a legal proceeding in which a jury either makes a
decision or makes findings of fact which are then applied by a
judge. It is distinguished from a bench trial, in which a judge or
panel of judges make all decisions.
The United States Constitution recognizes the right to a jury
trial to be a fundamental civil liberty or civil right that allows the
accused to choose whether to be judged by judges or a jury.
Juries usually weigh the evidence and testimony to determine
questions of fact, while judges usually rule on questions of law.
Any irregularities in trial procedure or jury verdict may result
in an appeal.
